Penalties for A Second DUI in California

Under VC 23152, the penalty for a second DUI within 10 years of being convicted for a separate DUI or wet reckless driving charge, can result in imprisonment in county jail for a period of 90 to 364 days, as well as a fine of $390 to $2,000. Additionally, your driver’s license will be suspended for a period of 2 years by the DMV.

Under VC 23542 and other terms and conditions imposed by the court, you can be confined in county jail and fined as conditions of your probation. Penalties include:

  • Imprisonment for a period of 10 to 364 days. A fine of $390 to $2,000.
  • Imprisonment for a period of 96 hours to 364 days. A fine of $390 to $2,000. A sentence of 96 hours shall be served in two increments consisting of a continuous 48 hours each.

If convicted of a DUI under VC 23152, the DMV will suspend your driver’s license for a period of 2 years. Courts have the discretion to require you to do either of the following things:

  • Enroll in a driving-under-the-influence program and participate for at least 18 months
  • Enroll in a driving-under-the-influence program and participate for at least 30 months
