DUI & The California Department of Motor Vehicle (DMV)

If you are arrested for DUI in California, there are 2 things you must address within 10 calendar days. They include the following:

  • California DMV wants to suspend your license
  • Criminal Courts in California want to prosecute you

The above 2 items are inter-connected; however, different rules and cases apply to each of the above situations. You must contact the DMV within 10 calendar days of your arrest and schedule a hearing, or your temporary license will be suspended after 30 days for 4 months. This will occur if you are over the age of 21, not a commercial driver, this is your 1st alleged DUI, there were no injuries to others, and you did not refuse to take a required chemical test.

The DMV also has the authority to impose a maximum suspension of 4 months for a 1st time DUI offense, see VC 13353.3. As you can imagine, there are different consequences for a 2nd DUI or more within a 10-year period. If you are convicted of a 1st offense DUI, under VC 23152, the DMV will suspend your driver’s license for a period of 6 months. See VC 13352 to learn more. If you are convicted of a DUI, your auto insurance premiums will be increased substantially for years, and an Ignition Interlock Device (IID) may be required in all cars you own and/or drive.
