Errors in Blood Testing in Orange County Crime Lab

There was a recent article in the Los Angeles Times regarding errors found in blood- alcohol testing. A few weeks ago, the Orange County Crime Lab discovered errors in the blood-alcohol testing for DUI cases. The results of these errors affected 2,200 DUI cases. Of these cases, 900 resulted in DUI convictions of the accused. The prosecutors have sent out letters to the defendants in these cases informing them of the errors. More errors have recently been found and there is a plan in place to request a state audit to review the testing procedures and standards at this lab. If you have been involved in this blood testing error scenario, you need to team up with a DUI lawyer right away to make sure your rights are protected.

Blood tests at this lab are tested on two machines, both showing errors during this time. The Lab Director stated that the specific errors involved in these tests were off by .003 percentage points for one testing machine. The second testing machine was said to have been off by .001 percent. These errors can go both ways, the authorities have said that at least 100 cases had an underestimated Blood Alcohol Content (BAC) reading. This means that the tests showed a level of .07, but in reality the BAC level was .08 making it above the legal limit. These errors are thought to have occurred over a span of five months, but the lab officials believe only about 200 cases were affected. While there are measures in place to prevent the occurrence of errors in the future, this is one example of the unreliability of blood test results.
