Congressmen Steve Cohen (D-TN) and Steve Chabot (R-OH) recently presented
the DUI Reporting Act. This bill is meant to change the way law enforcement
reports DUIs, addressing a loophole in regard to repeat-offenders due
to inconsistent reporting. However, there already is a DUI reporting act
which is called The Driver License Compact. It interesting to note the
State of Tennessee is not a member of The Driver License Compact.
However, this isn’t always the case. Our team at the Law Office of
Ivan O.B. Morse has handled many cases in which our clients have been
charged with a prior DUI which occurred out-of-state due to The Driver
License Compact. Most states are members of The Driver License Compact,
except for Georgia, Massachusetts, Michigan, Tennessee, and Wisconsin.
This is why our Dublin criminal defense attorney believes there is no
need for more legislation as it would be duplicative of an existing law.
The Interstate Driver License Compact and the National Driver Register
prevent people from obtaining drivers licenses in any state if they have
been convicted of multiple DUIs in the past and their license is suspended,
cancelled, or revoked at the present time.
In California, The Driver License Compact is found under California Vehicle
Code §§ 15000 et.seq. This is a compact to exchange data motorist's
home state. If an out-of-state motorist violates the law it is reported
to their home state. Each state has a distinct set of standards by which
they handle individuals convicted of DUI, and we believe it should remain as such.
