Upon a 1
time conviction, the DMV will suspend your driver’s license for
6 months offense and may also enforce a maximum suspension of 4 months.
Probation may last from 3 to 5 years. You also cannot drive a vehicle with
any alcohol in your blood. If your arrest violates VC 23152 or 23153,
you cannot refuse to submit to any chemical tests of your blood, breath,
or urine regarding alcohol intake. You will also be prohibited from committing
any further crimes, driving without valid insurance, or associating with
anyone your probation officer disapproves of. You must disclose your probation
terms with law enforcement, and submit to a search and seizure. You may
also be required to use an Ignition Interlock Device, or IID.
The court will likely also impose the following, according to VC 23152:
- A $390 to $2,000 fine and time in county jail ranging from 48 hours-6 months
- Enrollment, participation, and successful completion of a DUI program
- If your BAC was lower than 0.20%, you must participate for at least 3 months
or longer in a licensed program with no less than 30 hours of program
activities, including education, group counseling, and interview sessions
- If your BAC was 0.20% or more, or you refused to take a chemical test,
you must participate for at least 9 months or longer in a licensed program
with a minimum of 60 hours of program activities, including education,
group counseling, and interview sessions
