Factual Innocence
If arrested and not charged with a crime; or arrested, charged with a crime and then the charges are dismissed, there is a record that will follow you. One way to have this information eradicated from the system is to file a motion to be found factually innocent. If successful, the courts, the arresting agency, the Department of Justice and all law enforcement agencies are required to delete all information apertaining to this arrest from their systems.
