Ryan L. Smith
Ryan L. Smith is an attorney who has been practicing law with Ivan Morse
for five years. He has studied criminal law for over 8 years. He has worked
at the San Francisco District Attorney’s Office, Trial Integrity
Department; the San Francisco Public Defender’s Office, Police Misconduct
Unit; and the First District Appellate Project, preparing appeals on behalf
of the Public Defender. He has handled more than 600 cases as of January 2018.

When he is contacted by someone who has been arrested and accused of committing
a crime, the first thing Ryan does is have the person provide a detailed
chronology of the events leading up to the arrest while it is fresh in
their mind. Ryan wants to know what transpired prior to, during, and after
Ryan’s focus usually begins with whether an individual’s 4th Amendment rights were violated, that is, the right to be free from unreasonable
searches and seizures. Then, he examines your case for other possible
violations including; California statutory violations, Federal 5th Amendment violations (Miranda Rights), Federal 8th Amendment violations (right to reasonable bail), and Federal 1st Amendment violations (freedom of speech). A violation of law could result
in suppression of evidence, or even outright dismissal of the case.
If the court refuses to follow the law, Ryan is prepared to appeal to the
Appellate Division, the Court of Appeal, and even the State or Federal
Supreme Court. Ryan has had decisions of the Superior Court overturned
If the case is not dismissed, Ryan will work hard with the prosecutor to
secure a favorable plea bargain offer, or to prepare the case for criminal
jury trial. Sometimes it is even possible to obtain a plea bargain offer
where the case is dismissed after certain conditions are met.
